Preamble
These General Terms and Conditions of Sale (GTC) govern the sale of products offered by TIPI4x4 during direct sales. They apply, without restriction or reservation, to all orders placed with TIPI4x4 by its professional or individual clients. Consequently, any order implies full and unconditional acceptance of these terms by the client.
Purpose
These terms aim to define the conditions of sale for travel cells for pickup trucks manufactured by TIPI4x4.
Products
TIPI4x4 offers travel cells designed for pickup trucks, along with related accessories and equipment. The characteristics and specifications of the products are available on the website or upon request. Products are either custom-made or available in stock depending on the reference.
Orders
Orders are placed by accepting a quotation, a contract, and the general warranty terms. Any order is considered firm and final upon confirmation by TIPI4x4, subject to the following conditions:
- Product Availability: Products are subject to stock availability or production.
- Custom Orders: For custom-made products, the client must provide all necessary information for manufacturing (dimensions, options, etc.).
Prices
The prices of the products are indicated in euros, excluding taxes (HT) and including all taxes (TTC) according to applicable tax regulations. Delivery costs are additional and will be specified before order confirmation. TIPI4x4 reserves the right to modify its prices at any time; however, products will be invoiced based on the rates in effect at the time of the order.
Payment Terms
Payments are made according to the schedule agreed upon in the contract and can be made via:
- Bank transfer
- Check (subject to prior approval from TIPI4x4)
In case of late payment, late payment penalties may apply.
Delivery
Products are delivered to the address specified by the client at the time of the order. Delivery times are indicative and do not bind TIPI4x4 in case of delays. The client must inspect the condition of the products upon receipt and notify TIPI4x4 of any reservations within 48 hours.
Delivery costs are borne by the client and calculated based on the weight and delivery location. TIPI4x4 reserves the right to choose the carrier.
Transfer of Ownership and Risk
Products remain the property of TIPI4x4 until full payment is received. However, the risks associated with the products are transferred to the client upon delivery.
Warranty
Products sold by TIPI4x4 are covered by the legal warranty of conformity and the warranty against hidden defects. The warranty period is 2 years from the date of receipt of the products. Defective products must be returned to TIPI4x4 within 30 days of the defect being discovered.
Liability
TIPI4x4 shall not be held liable for indirect or intangible damages resulting from the use of its products. Furthermore, TIPI4x4 disclaims any liability for product usage that does not comply with the instructions or recommendations.
Force Majeure
TIPI4x4 shall not be held responsible for failure or delay in fulfilling an order due to an event of force majeure as defined by prevailing case law.
Intellectual Property
The elements on TIPI4x4’s website, as well as the products, are protected by intellectual property rights. The client agrees not to reproduce, use, or exploit these elements without prior authorization from TIPI4x4.
Personal Data Protection
TIPI4x4 collects personal data as part of order processing. These data are handled in compliance with the French Data Protection Act and the General Data Protection Regulation (GDPR). The client has the right to access, correct, or object to the use of their personal data.
Disputes and Applicable Law
These terms are governed by French law. In case of disputes, the parties shall seek an amicable resolution. Failing that, the competent court will be the one in the jurisdiction of TIPI4x4’s registered office.
